(1) Cases punishable with a fine up to two lakh rupees or imprisonment up to one year or both under this Act shall be dealt with and settled by the Divisional Forest Officer of the Government of Nepal.
(2) Procedures as per the Special Courts Act 2059 shall be adopted while proceeding and disposing of the case in accordance with sub-section (1).
(3) Under this Act, a person arrested for an offense punishable by a fine of up to one thousand rupees may be immediately released after being fined by the officer who has reached the rank to investigate the case.
(4) The party who is not satisfied with the decision under sub-section (1) or (3) may appeal to the relevant district court within thirty-five days from the date of notification of the decision.
